"We are telling the court that this industry has, in fact, not been exempted from the EPBC and that the minister should no longer delay her decision on the requests for her to reconsider and halt the Macquarie Harbour fiasco,"Mr Allan said.
"We've got confidence. From what we've been told by the Australian government and the people who drafted legislation … they're confident it should hold against any legal challenges. But then again, that's for the courts to decide,"he said.
"It's green lawfare. This is what they specialise in."
