"They do intend to form a political party and it would be a radical departure in Australian constitutional jurisprudence for that political ideology to be outlawed,"he said.
"That's why prosecution sought the non-association order, to prevent that occurring in the future, particularly in light of the fact that Anzac Day is approaching,"she said.
"It's not a swastika but on the prosecution case it is, for the purposes of the legislation, a Nazi symbol,"she said.
